Pleading Insanity In The American Justice System

In the American Justice System, for someone to plead not guilty by reason on insanity is a big deal, but usually pretty pointless.

This approach rarely works to either free your client or get him or her detoured to a local state or federal mental health facility unless they are retarded or something. In a land where we execute children, retards, and whomever else we can for violent crimes, you are pretty much fucked if you want an American jury to say your crazy. 

There has only been one serial killer in American History to be found innocent by reasons of insanity and that was Ed Gein. The only reason it worked for him was because he had dug up his own mother, brought her back home, dressed her up in her favorite dress and in her favorite chair over looking her favorite view from an upstairs bedroom window and then made household items like lamp shades and belts out of his victims skin and bones.  I think that must’ve offended the sensibilities of the community at the time.

Now here is my question. Why must someone not know the difference between right and wrong to be insane?  I can think of plenty of people that know the difference between right and wrong and are pretty fucking crazy to me.  As a matter of fact, I am willing to venture so far as to say that if you know something is going to lead you to some pretty harsh consequences and you still do it anyway without fear or concern for your own safety, that is pretty crazy.

You tell me how someone can kill 17 people, keep them around the house, posed in certain positions i.e. playing cards and the kitchen table, leaning against the wall smoking a cigarette, keep people on ice in your bathtub so you can have sex with them and or eat them later if you get hungry and not be crazy?  When we say that he isn’t crazy are we saying that he is…uh, normal like the rest of us that cheat on our taxes? We know what we are doing when we do it therefore we are not crazy? 

Albert Fish went around the country eating children, putting alcohol soaked cotton balls in his anus and then setting them on fire in his asshole. In his case the jury even said, “yeah we know he is crazy but since he ate kids we want to see him die anyway.” 

In America we need to do one of two things. One, either we allow ourselves the ability to execute crazy people without guilt, since you know, most Americans wouldn’t call it a Justice system if we couldn’t execute somebody. Or two, expand our definition of crazy to fit people that obviously know what they are doing but are obviously not telling time on a clock with numbers or hands on it.  Let’s say, like an actor playing a role, who is responsible for finding a character, if the jury cannot find the “motivation” for a criminals actions, then he or she is nuts.  If you cannot see what could possibly motivate someone to do what Eric and Dylan did in Columbine after hearing all of the evidence then they are crazy. If eating people gives you sexual pleasure, or if you heard a defendant say that he is doing all he can to kill every single living person on planet earth so that the homicidal alien sex-crazed midgets from planet Bloopkog can have their way with him and you find it slightly odd that they would communicate to him every morning by spelling words out in his bowel of fruit loops, if that fucking doesn’t sit right with you, forget that he knew killing was wrong…is he still nuts or isn’t he?
