A 22-year-old San Francisco woman has sued MTV Networks and parent Viacom Inc., alleging invasion of privacy after her image appeared on a Sunset Boulevard billboard, in People and Rolling Stone magazines and on an episode of the MTV program, "Bands on the Run."
Dana Lynn Daly contends that a video crew followed her into the women's bathroom of a nightclub and taped her as she kissed, straddled and felt up a male band member in a bathroom stall. The footage was featured on the April premiere of "Bands on the Run." An image of a "stunned" Daly was included in a photo montage used in advertisements for the show on billboards and magazines.
Now she is pissed off because she says that although she did signed a waiver that allowed MTV to use her image, she was really drunk that night and didn't know what she was doing. She contends that that the use of her image falsely implied that she had sexual relations with the dude and that the picture of her shoving her tongue down his throat in a bathroom stall was "misleading".
Daly's San Francisco attorney, R. Michael Lieberman, said MTV producers presented a drunk Daly with a consent form to sign. "She was intoxicated," Lieberman said. "MTV should not have presented a consent form to her or insist that she sign it when she was intoxicated."
So we are to believe that your client was too drunk to know that what she was signing but she wasn't drunk enough to have sex with the stranger that she was making out with in the bathroom stall? Correct me if I am wrong but how many reasons are there that you could use to explain why would a drunk woman take band member into a bathroom stall? She already admits that she was in the women's bathroom stall suffocating him with her tongue and that is all the picture shows her doing?
Why would we think it went any further than that?
